Responsibilities include:

  • Manage the ethical wall process, including identification of individuals to be screened from clients and matters, implementation of ethical walls, and periodic reviews to determine the need for ongoing or updated restrictions;
  • Evaluate and support the implementation of compliance procedures including technical upgrades and new technologies;
  • Work with internal departments to organize and document client files, including receiving and filing engagement letters, ensuring engagement terms are properly input and tracked in our systems; and overseeing the electronic and paper document archiving process, including notification, collection, and disposition of client files;
  • Monitor changes to the ethical standards governing the legal profession, including by maintaining up-to-date knowledge of the Rules of Professional Conduct of both the District of Columbia and the American Bar Association, and evaluate firm policy for compliance;
  • Work with Risk Management Counsel and/or General Counsel on requests related to privacy laws; and
  • Work on special projects as requested by the Professional Responsibility and Risk Management Counsel and General Counsel.

Requirements include:

  • Juris Doctorate (J.D.) is required. License to practice law in the United States is required;
  • Minimum five (5) years of experience practicing law or experience in a similar conflicts, professional liability or compliance role in a large law firm setting strongly preferred.
  • This position has a hybrid work schedule with a minimum of two days per week in the office.

  • Identify and analyze potential conflicts issues; initiate discussions with attorneys, Risk Management team and General Counsel when necessary; provide recommendations for resolution and ensure clear documentation of resolutions for Risk Management team members; draft and review conflict waiver requests and perform necessary follow up for conflict resolution
  • Manage the ethical wall process, including identification of individuals to be screened from clients and matters, creation of ethical wall memoranda, implementation of ethical walls, and periodic reviews to determine the need for ongoing or updated restrictions
  • Evaluate and support the implementation of compliance procedures including technical upgrades and new technologies for new business intake and other ethics and compliance related activities
  • Review and provide advice and guidance related to client-tendered requirements and agreements, including proposed engagement letters, outside counsel guidelines, etc. and work with firm attorneys to prepare responses that align with recommendations and firm policies
  • Supervise the review of professional staff and lateral attorney candidate conflicts assessments and questionnaires and all search results prepared by the conflicts team
  • Identify and analyze potential conflicts of interest regarding professional staff and lateral attorney candidates including specialized conflict rules applicable to former government employees; implement all necessary screening; evaluate any applicable rules of the government agency
  • Assist with attorney orientation presentations, training and integration related questions pertaining to conflicts, ethics and professional responsibility
  • Engage in performing legal research on ethical obligations and professional liability issues

  • Prepare clear and concise reports documenting the results of specific conflict searches.
  • Work with attorneys to document conflict clearances.
  • Review submitted data for new client and client/matter acceptance. Research accuracy and quality of information as well as potential client relationships
  • Review, analysis, and indexing of engagement letters.

Requirements:

  • Bachelor’s degree and 2 years’ experience in a law firm as a legal assistant or in conflicts/new business intake operations preferred.
  • Demonstrated proficiency in Microsoft Office Suite. Strong research skills. Knowledge of database architecture a plus. Proven aptitude to learn new software applications. Prior experience in utilizing conflicts systems preferred.
  • Interpersonal communication skills necessary to maintain effective relationships with partners, attorneys, clients and staff.
  • Demonstrated ability to maintain confidentiality.
  • Strict attention to detail and strong customer service skills.

Overview

  • Porzio, Bromberg & Newman, P.C., a full-service law firm with eight offices in strategic hubs around the region, and two wholly-owned subsidiaries, seeks to hire a Conflicts Director in its Morristown, New Jersey office.
  • The Director works closely with Firm attorneys to ensure the Firm’s compliance with ethical rules governing lawyers, including prioritizing, analyzing, and presenting relevant hits to practicing attorneys on easy to interpret conflicts reports.

So this update and posting is worth reading not only by those who might be interested in this specific position, but also by those looking to scope and define similar roles in their organizations, as I found it well crafted.)

Arnold & Porter is seeking: “Client Guidelines Attorney” —

  • The Conflicts & Client Intake Department of Arnold & Porter has an opening for a Client Guidelines Attorney in the Washington, DC office.
  • The Client Guidelines Attorney is responsible for ensuring that established policies and procedures to memorialize the relationship between Arnold & Porter and its clients from all domestic and global offices are effectively implemented under the supervision of the Director of Professional Responsibility, and in collaboration with Arnold & Porter’s Office of General Counsel, the client Relationship Partner, the Director of Client Service & Compliance, and others as necessary.
  • To fulfill this responsibility, the Client Guidelines Attorney must understand and reconcile the terms of firm-generated client retention documents with the terms of client-generated retention documents, such as outside counsel guidelines (OCGs), that may to some degree conflict with Arnold & Porter’s ethical obligations, business goals and/or risk tolerance.
  • The Client Guidelines Attorney then must be able to communicate effectively with all levels of firm management, attorneys, and staff to describe what measures should be taken to ensure Arnold & Porter and its clients have retention expectations that are clearly understood, aligned, and recorded.
  • While it is not necessary to have broad experience with or knowledge of the professional responsibility rules governing the attorney-client relationship to be considered for this position, the Client Guidelines Attorney is expected to become fluent in such rules quickly and contribute as a subject matter expert in discussions concerning analyses of client OCG terms as well as discussions of how to improve Arnold & Porter’s policies and procedures in this area.

Responsibilities include but are not limited to:

  • Working collaboratively and proactively under the supervision of the Director of Professional Responsibility to ensure that established policies and procedures to memorialize the relationship between Arnold & Porter and its clients are effectively implemented.
  • Providing assistance and guidance to the Relationship Partner and client team members drafting, negotiating, interpreting, and implementing the terms of time-sensitive client OCGs, other client-generated retention documents, client Requests for Proposal (RFPs), firm-generated retention documents, or some combination thereof.
  • Communicating effectively both internally and externally to describe what measures should be taken to ensure Arnold & Porter and its clients have retention expectations that are clearly understood, aligned, and recorded.
  • Providing contextual analysis and critical assessment of client OCGs, non-standard client retention documentation, and RFPs and follow up as needed with the Relationship Partners and others to ensure proper documentation and resolution of outstanding issues.
  • Monitoring global compliance with negotiated client OCG terms that may include, among other things, running conflicts on affiliated corporate entities, using form waivers, providing client notice, implementing ethical walls, and updating the firm’s conflicts and client intake databases and repositories.
  • Soliciting and coordinating feedback and/or approval on client OCGs and other client-generated retention documents from Arnold & Porter subject matter experts.
  • Liaising with practice groups to address practice group compliance and considerations.
  • Developing an expertise in technologies used by Arnold & Porter to perform job responsibilities and maintain market awareness of new or better technologies that may improve Arnold & Porter processes.

Qualifications include:

  • Four-year college degree and J.D. are required; preexisting active bar admission in at least one jurisdiction in good standing where the firm maintains an U.S. office is preferred and, if not achieved at the date of hire, will be required as a term of employment shortly after beginning employment.
  • A minimum of one year of work experience in the area of conflicts of interest or other relevant experience (e.g., commercial contracts, new business intake, ethics) at a large law firm and some prior experience as a practicing attorney preferred.
  • Experience with conflicts databases and researching corporate entities using Mergent, Edgar, Hoovers, Dun & Bradstreet or other corporate databases a plus.

  • The Conflicts Analyst will report to Director of Risk Management and Client Intake Services and will work closely with other senior team members within the Client Intake and Conflicts department supporting the Firm’s critical risk management function.
  • The Conflicts Analyst role is primarily responsible for analyzing and evaluating potential legal, ethical or business conflicts presented by new business and laterals coming into the firm.

Position Responsibilities Include:

    • Prepares a conflicts database search, report and analysis of conflict information for attorneys to facilitate firm business intake and lateral attorney onboarding. Conflicts analysis will also include utilizing other research tools to properly identify clients, conduct due diligence and identify any risk concerns or issues.
    • Provides preliminary guidance and analysis for attorneys in resolving potential issues and conflicts. Assists with questions, additional research and training as required.
    • Supports Business Review Committee and Firm Counsel by providing conflicts information for identified issues, projects and conflicts monitoring.
    • Participates in client intake assignments and special database projects including periodic software updates, testing and troubleshooting.

Position Requirements and Desired Skills:

    • Bachelor’s Degree
    • JD Degree, Law Firm experience or other qualifications relating to the practice of law are preferred
    • Familiarity or experience with the rules governing conflicts of interest for lawyers as well as Intapp Open or other law firm conflicts software is a plus
    • Experience in working with large databases in a technology-driven environment
    • Ability to maintain strict confidentiality and adhere to firm policies and procedures
    • Excellent oral and written communication skills

So I’m particularly pleased to highlight a new opening from a repeat “customer” of the BRB jobs board, Moore & Van Allen, a prominent law firm of more than 300 attorneys with offices in the Carolinas. They’re looking for a: “Conflicts Analyst” —

  • This is a full-time, remote work eligible position within our Conflicts team.
  • Duties include:
    • Performance of database research to identify and analyze potential conflicts of interest during new business intake and when hiring new attorneys and staff
    • Responding to attorney and staff inquiries about conflicts; managing the conflicts database; and assisting the department with various other duties.
  • The successful candidate will possess:
    • A bachelor’s degree, or the equivalent in experience, plus an additional year of legal or database experience in a professional environment.
    • Candidates must already be, or are able to become, proficient in Intapp Open and Aderant software systems and basic legal conflicts of interest analysis
    • Must possess excellent demonstrated analytical and problem-solving skills and strong research and organizational abilities

BRB Risk Jobs Board — Conflicts Counsel & Manager (Eversheds Sutherland)

Conflicts Counsel & Manager” — The Conflicts Counsel & Manager executes the overall strategy for and management of processes related to the analysis and resolution of potential conflicts. The Conflicts Counsel & Manager will also be responsible for managing the firm’s new business intake and conflict checking systems. This includes management of the remote conflicts team.


Responsibilities and Duties Include:

  • Assesses potential conflicts identified by the Conflicts Analysts and Conflicts Coordinators, whether arising as a result of new business intake for Eversheds Sutherland (US) LLP Eversheds Sutherland (International) LLP, or incoming lateral attorneys; determines when a conflicts review should be escalated to the Director of Conflicts and Client Information.
  • Ensures all requests are being handled accurately and in compliance with the Global Conflicts Process and Global Conflicts Policy.
  • Supervises the establishment of ethical screens and monitors compliance with such screens.
  • Maintains knowledge of current laws and rules pertaining to conflicts of interest in each jurisdiction in which the firm maintains an office and ensures consistent conflicts and ethics practices across all of the firm’s offices.
  • Reviews client-provided outside counsel guidelines for non-standard engagement terms and maintains a database of client-specific engagement terms.
  • Helps design and facilitates improvement of the firm’s new business intake and conflicts system.
  • Ensures the conflicts team is trained on applicable Firm systems and processes relating to conflict resolution.
  • Maintains a training manual for the Conflicts Analysis team.
  • Manages the entire conflicts team to include Conflicts Analysts, Conflicts Coordinators, Conflicts Counsel and Conflicts Analysts.
  • Recommends process improvements and implements the same upon the approval and direction of the Director of Conflicts & Client Information.
  • Determines appropriate staffing levels and hourly shifts to ensure global service coverage.

Knowledge, Skills, and Abilities Include:

  • A JD from a recognized law school, in addition to a Bachelor’s degree from an accredited college or university. Admission to a bar in a jurisdiction in which the firm has an office in the U.S.
  • At least four years of combined experience as a practicing attorney in a law firm or equivalent experience, combined with recent law firm conflicts, new business intake, rules of professional conduct and ethics experience. Experience working in and supporting a matrixed, multi-location and multi-office organization. Global Law firm experience is preferred.
  • Strong technology skills and the ability to embrace and master new technologies easily and effectively. Experience on current legal applications and technology including Intapp Conflicts, Intapp Wall Builder, Agile Point BPM and Aderant desired.
